Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuyWatch websites (including macbuywatch.com and buywatchhq.com), checkout, onboarding, and related alert channels (the "Service"). BuyWatch (buywatchhq.com) is the service operator ("BuyWatch," "we," "us," or "our"). Contact: hello@buywatchhq.com.

By accessing or purchasing the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service (notify-only)

BuyWatch monitors product availability signals for scarce Mac and GPU products and sends notify-only alerts via channels such as email, Telegram (@BuyWatchAlertsBot), and Discord (Josh's BuyWatch server).

• BuyWatch does not place orders with Apple or any retailer on your behalf.
• You are solely responsible for deciding whether and how to purchase, and for completing any checkout on third-party sites.
• BuyWatch is not affiliated with, endorsed by, or sponsored by Apple Inc. or any retailer.
• We do not currently offer SMS/text alerts.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase or use the paid Service. By using the Service you represent that the information you provide is accurate and that you will keep contact channels (email, Telegram, Discord) usable for delivery.

3. Products and pricing

Current offerings (prices as stated at checkout; subject to change for new purchases):

• Product launch watch — $97 one-time (single Stripe Checkout charge)
• Back in stock watch — $57 per month (Stripe subscription; typically opens after a launch sellout)

Features, covered SKUs, and channel details are described on the applicable product page at the time of purchase. We may update product descriptions prospectively; material changes to an active paid plan will be communicated reasonably when practicable.

4. Payments (Stripe)

Payments are processed through Stripe Checkout (hosted). By completing checkout you authorize Stripe to charge the stated amount (and recurring amounts for subscriptions) using the payment method you provide.

• BuyWatch does not store full payment card numbers.
• Card and payment data are handled by Stripe under Stripe's terms and privacy policy.
• You are responsible for applicable taxes where required.

Failed subscription payments may cause Stripe to stop renewing; when the subscription ends, restock alerts stop.

5. Subscriptions, renewal, and cancellation (Back in stock)

The Back in stock watch auto-renews monthly via Stripe until you cancel or payment fails in a way that ends the subscription.

How to cancel renewal

• Use the Stripe Customer Portal when we provide a link, or
• Email hello@buywatchhq.com with the email used at checkout and a clear request to cancel

Cancellation stops future subscription charges. Unless we expressly state otherwise in writing, we do not provide prorated refunds for the unused portion of a billing period already paid.

6. Stopping LIVE alert beats (launch / LIVE windows)

During a LIVE alert window:

• Reply CANCEL in Telegram to stop further email and Telegram beats for that LIVE.
• Discord broadcast channels (for example #live) are not muted by CANCEL. Mute the channel or leave the server in Discord if you do not want those messages.
• Email inbound CANCEL is not automated. For account-level stops or billing, contact hello@buywatchhq.com (or use Stripe Customer Portal when available).

7. Post-launch list handling

On or after the day following a completed launch go-live, Product launch clients may be removed from active alert lists. We may retain purchase and related records as needed for accounting, support, fraud prevention, and legal obligations, as described in our Privacy Policy.

8. Refunds

BuyWatch sells a digital alert service.

Product launch ($97 one-time)

Contact hello@buywatchhq.com within 7 days of purchase if your watch was never activated and no LIVE window for your covered product has started. Approved refunds are issued at BuyWatch's reasonable discretion to the original payment method via Stripe.

Back in stock ($57/mo)

Cancel to stop future charges. No prorated refund for the current paid period unless we agree otherwise in writing. Failed payment that ends the subscription stops alerts; it is not a refund of prior successful charges.

Chargebacks

You may also pursue remedies available through your card issuer or Stripe. We ask that you contact us first so we can help resolve the issue quickly.

Nothing in this section limits non-waivable consumer rights under applicable law.

9. No availability or purchase guarantee

Alerts are informational only. Without limiting other disclaimers:

• We do not guarantee that any product will become available, remain in stock, or be purchasable at any price.
• We do not guarantee that you will successfully complete a purchase, obtain an allocation, or receive a shipment from Apple or any retailer.
• Alerts may be delayed, incomplete, duplicated, mistimed, or fail due to network issues, retailer site changes, rate limits, platform outages (email, Telegram, Discord, Stripe), configuration errors, or force majeure.
• Retailer inventory, pricing, cart limits, account requirements, and checkout rules are outside our control.
• You remain solely responsible for your purchasing decisions and any losses related to missed or failed purchases.

10. Acceptable use

You agree not to:

• Use the Service unlawfully or to harass others
• Resell, sublicense, or commercially redistribute BuyWatch alerts without our prior written consent
• Attempt to probe, overload, or disrupt our systems or third-party platforms we rely on
• Impersonate BuyWatch, Apple, or others
• Share access in a way that materially exceeds a personal household use without our agreement
• Scrape our sites in a way that harms availability or violates these Terms

We may suspend or terminate access for violations, abuse, or chargeback fraud.

11. Intellectual property

BuyWatch name, logo, site content, and Service materials are owned by BuyWatch or licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for personal alert purposes while your purchase is active. Apple and other retailer names and marks belong to their owners and are used only for identification of monitored products.

12. Third-party services and links

The Service depends on third parties including Stripe, email providers (e.g. Resend, Zoho), Telegram, Discord, hosting providers, and retailer/Apple websites. Those services have their own terms. We are not responsible for third-party outages, policy changes, bans, or content outside our control. Links to third-party sites are for convenience only.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that alerts will be timely, uninterrupted, error-free, or that the Service will meet your expectations or result in any purchase.

14. Limitation of liability

To the maximum extent permitted by law, BuyWatch will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or opportunity (including missed product purchases or allocations), arising from or related to the Service or these Terms, whether based on warranty, contract, tort (including negligence), or any other theory, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to BuyWatch for the Service in the three (3) months before the event giving rise to liability, or (b) USD $97.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless BuyWatch from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your interactions with Apple, retailers, or other users, except to the extent caused by our willful misconduct.

16. Termination

You may stop using the Service and cancel subscriptions as described above. We may suspend or terminate the Service or your access if you breach these Terms, if required by law, if payment fails, or if we discontinue the Service. Provisions that by nature should survive (including payment obligations accrued, disclaimers, limitations of liability, and indemnity) will survive termination.

17. Governing law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your place of residence require otherwise. Courts located in Colorado may hear disputes, subject to applicable consumer venue rights.

18. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes will be posted on this page; we may also notify you by email or through the Service. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service and cancel any subscription.

19. Entire agreement; severability

These Terms and the Privacy Policy are the entire agreement between you and BuyWatch regarding the Service and supersede prior understandings on that subject. If a provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
